By accessing and using the East Bay Postpartum Doula Circle website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or Services. We reserve the right to modify these Terms at any time, and your continued use of the Services following any changes constitutes acceptance of the revised Terms.

Services Description

East Bay Postpartum Doula Circle provides a referral and coordination service connecting families with professional postpartum doulas throughout the San Francisco Bay Area. Our services include daytime postpartum support, nighttime newborn care, breastfeeding and lactation support, sleep guidance, and care for families with multiples. The specific scope of doula services will be outlined in your individual service agreement with your assigned doula.

Independent Contractors

All postpartum doulas affiliated with East Bay Postpartum Doula Circle are independent contractors, not employees. Each doula operates their own independent practice and is solely responsible for the services they provide.

• Doulas maintain their own professional training, certifications, and insurance.
• East Bay Postpartum Doula Circle does not control the methods, techniques, or specific care decisions made by individual doulas.
• Individual service agreements are between the client and the doula directly.
• East Bay Postpartum Doula Circle facilitates the connection between families and doulas but is not a party to the care relationship.

User Responsibilities

By using our Services, you agree to:

• Provide accurate, current, and complete information when submitting inquiries or booking services.
• Communicate openly and honestly with your assigned doula about your needs, preferences, and any relevant health information.
• Treat all doulas and staff with respect and professionalism.
• Provide a safe working environment for your doula, free from harassment, discrimination, or unsafe conditions.
• Comply with the terms of any individual service agreement entered into with your doula.
• Not use our website for any unlawful purpose or in any way that could damage, disable, or impair the site.

Payment Terms

• Fees for doula services are determined by each independent doula and will be communicated to you prior to the start of services.
• Payment terms, including deposits, payment schedules, and accepted methods of payment, are outlined in your individual service agreement with your doula.
• Cancellation and refund policies are set by each individual doula and will be detailed in your service agreement.
• East Bay Postpartum Doula Circle is not responsible for billing disputes between clients and individual doulas.

Limitation of Liability

To the fullest extent permitted by applicable law, East Bay Postpartum Doula Circle, its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of our website or Services. Our total liability for any claim arising from these Terms or your use of the Services shall not exceed the total amount paid by you to East Bay Postpartum Doula Circle in the twelve (12) months preceding the claim.

Our website and Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

• Postpartum doulas are not medical professionals. Doula services are not a substitute for medical care, and doulas do not diagnose, treat, or prescribe.

• We do not guarantee the availability of any specific doula or that our Services will meet your specific expectations.
• We are not responsible for any actions, omissions, or conduct of individual doulas outside the scope of their engagement.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Alameda County, California. You agree to submit to the personal jurisdiction of such courts and waive any objection to venue in such courts.
